Terms and conditions of bespoke commission

A plain account of what you can expect from us, and what we ask of you, when commissioning a piece. We will issue a printed copy with every order acknowledgement. Last reviewed on 12 May 2026.

1. The agreement

These terms govern the bespoke furniture commission contract between Cleariqo Atelier Sdn Bhd (‘we’, ‘us’) and you, the client. A commission is considered open once both parties have signed an order acknowledgement and the design fee has been received in cleared funds.

2. Design stage & design fee

Before any timber is cut, we will issue shop drawings, a wood sample in the chosen finish, and a fabric or leather swatch where relevant. This work is covered by a design fee, charged at the rate quoted in your initial proposal. The design fee is fully refundable: if you elect to proceed with the build, the full design fee is credited against the build price. If you choose not to proceed within ninety days of receiving the drawings, the design fee is non-refundable but the drawings remain yours to use.

3. Deposits & payment terms

Upon approval of drawings, we require a fifty percent deposit of the build price to begin work. The remaining fifty percent is due on completion, before delivery. Payment is by direct bank transfer in Malaysian Ringgit. We do not accept credit cards for amounts above RM 5,000.

4. Lead times

Indicative lead times are stated on each collection page and in your individual quotation. They run from the date of approved drawings, not from the date of initial enquiry. We will keep you informed of progress at the joinery, upholstery and finishing stages, and we will notify you as soon as we know if a stage is likely to overrun.

Reasonable delays caused by force majeure events (severe weather, supplier insolvency, infrastructure failure, pandemic, government action) do not entitle either party to terminate the contract. We will, however, work to recover the schedule.

5. Variation & change orders

Once drawings are approved and the build has begun, changes to dimensions, materials, finish or upholstery may incur additional cost and/or extend the lead time. We will issue a written change order for your approval before proceeding. Small detail adjustments (a turned-leg profile, a fielded versus flush panel) are generally absorbed without additional cost.

6. Delivery, installation & risk

Delivery within the Klang Valley is performed by our own crew and is included in the build price unless otherwise stated. Delivery outside the Klang Valley is by an appointed furniture-specialist haulier, quoted separately. Risk in the piece passes to you upon delivery and acceptance at your premises.

You must ensure that the route into the property — lift, door, stairwell, hallway — can accommodate the piece. We measure these during the design stage; if circumstances change between order and delivery, please advise us in advance.

7. Warranty

We warrant the joinery and frame of every piece for the lifetime of the original commissioning client, provided the piece is used for its intended residential or light commercial purpose and is kept in a reasonable indoor environment. The upholstery is warranted for five years; the surface finish for ten years. Hardware (brass pulls, soft-close hinges, bolts) is warranted for two years from delivery.

Repairs and refinishing work falling within these warranties are carried out free of labour at the workshop. The cost of replacement materials (foam, fabric, leather, hinges) is charged at our cost price. Transport to and from the workshop within the Klang Valley is included.

8. Defects on delivery

You have fourteen days from delivery to inspect the piece and notify us in writing of any defect that we may have missed. We will return to your premises to inspect any reported defect and to remedy it at our cost.

9. Cancellation

You may cancel a commission at any point. Cancellation before drawings are approved costs you nothing beyond the non-refundable design fee. Cancellation after drawings are approved but before build commences will retain the design fee plus a ten-percent cancellation charge. Cancellation after build has commenced will retain fifty percent of the build price; we will, on request, deliver the partially built piece to you in its current state.

10. Intellectual property

Shop drawings produced for your commission belong to you for the purpose of that commission. Cleariqo retains the right to photograph and to reproduce images of any finished piece for our own portfolio, journal and marketing materials, unless you ask us in writing not to. We will not name you, your address, or any identifying detail in any such reproduction without your written permission.

11. Governing law

This contract is governed by the laws of Malaysia, and any dispute will fall under the exclusive jurisdiction of the Kuala Lumpur courts.
